The Short Answer
The National Vessel Documentation Center (NVDC) never received and recorded a proper Satisfaction of Mortgage.
That can happen for several simple reasons:
- The bank never sent the Satisfaction of Mortgage to the NVDC.
- The bank sent the Satisfaction to you and expected you to file it with the NVDC.
- The Satisfaction was mailed to the NVDC but was lost or never received.
- The document submitted wasn't sufficient for the NVDC to record the mortgage satisfaction.
Does That Mean I Still Owe the Bank?
Not necessarily.
Paying off the loan and removing the recorded mortgage from the vessel's USCG record are two separate things.
The loan may have been paid in full, but until the NVDC receives and records the proper Satisfaction of Mortgage, the mortgage can continue to appear on the vessel's Abstract of Title.
Why Does This Matter When I Sell the Boat?
Because when your vessel is being sold, we want the Abstract of Title to show that the recorded mortgage has been properly satisfied.
If an old mortgage appears, WaterProof may need to work with the lender to obtain the appropriate Satisfaction of Mortgage and have it recorded with the NVDC.
Sometimes that's easy.
Sometimes the original bank has merged, changed names, been acquired three times, and suddenly we're doing banking genealogy. ๐ต๏ธโโ๏ธ
The bottom line
So if your loan has been paid but the mortgage still appears on the Abstract, don't panic. It usually means the payoff happened, but the final piece of paperwork never made it across the finish line.
